1. About us and these Terms
These Terms of Service (“Terms”) apply when you access or use the website at https://kanjade.com (the “Website”), create an account or purchase products through the Website.
The Website and the Kan Jade business are operated by Blue Lantern Ltd, trading as Kan Jade (“Kan Jade”, “we”, “us” or “our”).

Our registered office is provided through a third-party registered-office service. It is used for statutory company purposes and is not a retail shop, trading location, customer-service location or returns facility. Please do not visit this address or send customer correspondence, products or returns to it.

Please read these Terms before placing an order. These Terms, together with our Privacy Policy, Refund Policy and Shipping Policy, explain your rights and responsibilities when using the Website or purchasing products from us.
Nothing in these Terms affects your statutory rights as a consumer.
2. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into a contract to place an order through the Website.
If you are under 18, you may browse the Website only with the involvement of a parent or legal guardian. Any order must be placed by someone aged 18 or over.
You do not need to create an account to browse the Website. If you create an account, you must:

not allow another person to use your account without permission; and

inform us promptly if you believe your account has been accessed without permission.
You are responsible for activity carried out through your account unless that activity results from something for which we are responsible.

Where reasonably possible, we will explain the reason for the suspension or closure and give you an opportunity to resolve the issue.
Closing or suspending an account will not affect an order that we have already accepted unless we have a lawful reason to cancel that order.
3. Product information
We take reasonable care to ensure that product descriptions, photographs, prices, dimensions, materials and availability information are accurate.
Because some of our products contain natural materials or are handmade, individual products may have reasonable variations in colour, pattern, texture, shape, dimensions or finish.
These natural or handmade variations are not necessarily faults. Any important characteristics or variations that a customer should reasonably know about will be explained on the relevant product page.
The appearance of colours on a screen can vary depending on the device and display settings used. This does not affect your rights if a product is materially different from its description.
Where a product is described as jade, jadeite, sterling silver, gold, gold-plated, handmade, Guatemalan or by reference to a hallmark, treatment or place of origin, that description will be based on information that we reasonably believe to be accurate.
Relevant product-specific information will be provided on the applicable product page.
Products supplied by us must comply with the consumer-protection laws that apply to your purchase. For UK consumers, this includes the requirement under the Consumer Rights Act 2015 that products be as described, of satisfactory quality and fit for any purpose made known to us. Australian and New Zealand consumers also benefit from the mandatory consumer guarantees and other protections that apply under their local law.
We may change or discontinue a product before an order is accepted.
A change will not affect an order that we have already accepted unless:

you agree to the change; or
-
the change is necessary to correct an obvious error and we give you the option to cancel the order.
4. Placing an order
When you submit an order, you are offering to purchase the products in your basket subject to these Terms.
Before submitting your order, you will have an opportunity to review and correct it. Please check the products, sizes, quantities, delivery address and contact information carefully.
After you place an order, we will send you an acknowledgement email. This confirms that we have received your order but does not necessarily mean that we have accepted it.
A contract between you and Blue Lantern Ltd is formed when we send you an order confirmation or dispatch confirmation expressly confirming our acceptance, whichever occurs first.
We may decline or cancel an order before acceptance where, for example:

the product is unavailable

we cannot authorise or verify payment

there is an obvious pricing or product-description error

we cannot deliver to the address provided

an applicable purchase restriction has been exceeded

we reasonably suspect fraud or unlawful activity

accepting the order would breach a legal or regulatory obligation.
If we decline or cancel an order after taking payment, we will refund the amount paid without undue delay using the original payment method.
5. Prices and payment
Prices may be displayed in pounds sterling (GBP), Australian dollars (AUD) or New Zealand dollars (NZD), depending on your location, selected market and Website settings. The currency in which you will be charged will be shown at checkout before you place your order.
If your payment method is denominated in a different currency, your bank or payment provider may apply its own exchange rate or charge a foreign-transaction fee. We do not control those rates or charges.
The price payable is the price displayed at checkout when you submit your order, subject to the correction of obvious errors.
The checkout will show the total price, including applicable taxes and delivery charges, before you are required to place and pay for your order.
We may change prices at any time, but a price change will not affect an order that we have already accepted.
If a product has been listed at an obviously incorrect price and the error could reasonably have been recognised as a mistake, we may decline the order before accepting it or contact you before acceptance and ask whether you wish to proceed at the correct price.
We will not charge you the corrected price without your agreement.
Payment is processed using the payment methods displayed at checkout. You confirm that you are authorised to use the payment method supplied.
Discount codes and promotions are subject to any specific conditions displayed with the relevant offer. Unless stated otherwise, they cannot be exchanged for cash, cannot be transferred, cannot be combined with another offer and may be withdrawn or changed before an order using the offer is accepted.
These conditions do not affect an order that we have already accepted.
6. Delivery
We currently deliver to eligible addresses within the United Kingdom, Australia and New Zealand, as described in our Shipping Policy.
Available delivery methods, estimated delivery periods and charges will be displayed on the Website or at checkout before you place your order.
Orders sent outside the United Kingdom may be subject to customs processing, import taxes, duties or carrier charges. Whether these amounts are collected at checkout or payable by you on import will be shown or explained where reasonably possible. Unless checkout expressly states that such amounts are included, you are responsible for any import taxes, duties or charges imposed by the destination country. We do not control customs authorities or their processing times.
We will deliver your order without undue delay and within the period agreed with you.
If no delivery period has been agreed, we will normally deliver within 30 days after the contract is formed unless a different period is permitted by law.
Delivery estimates are not guaranteed delivery dates unless we expressly agree that delivery by a particular date is essential.
We are not responsible for delays caused by events outside our reasonable control. If such an event occurs, we will contact you as soon as reasonably possible, provide available information about the delay and take reasonable steps to minimise the effect of the delay.
You may have the right to cancel the contract if:

we refuse to deliver

delivery by an agreed date was essential and we fail to meet that date
-
we fail to deliver within an appropriate additional period that you give us.
Responsibility for the products and the risk of loss or damage normally pass to you when you, or a person identified by you other than the carrier, takes physical possession of them.
If you arrange for an independent carrier that we did not offer as a delivery option, risk may pass when the products are delivered to that carrier, where permitted by law.
7. Change-of-mind cancellations
If you are a UK consumer purchasing online, you will usually have a legal right to change your mind and cancel the contract under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
Australian and New Zealand law does not generally require a retailer to accept a return solely because a customer has changed their mind. However, we extend our change-of-mind return arrangements to eligible customers in Australia and New Zealand on the terms set out in our Refund Policy. This is a voluntary policy and is additional to any mandatory rights you have under applicable local consumer law.
For UK statutory cancellations, the cancellation period begins when the contract is formed and normally ends 14 days after the day on which you, or a person nominated by you, receives the products. Our voluntary change-of-mind period for eligible Australian and New Zealand orders is described in our Refund Policy.
For an order delivered in multiple instalments, the cancellation period normally ends 14 days after the day on which the final instalment is received.
To exercise your right to cancel, you must make a clear statement informing us of your decision. You can do this by emailing support@kanjade.com.

You may use a model cancellation form if we provide one, but you are not required to do so.
After notifying us of cancellation, you must normally return the products within 14 days.
Unless a product is faulty, damaged, incorrect or otherwise does not conform to the contract, you will be responsible for the direct cost of returning it, provided that this responsibility was made clear before purchase.
You may handle a product only as much as reasonably necessary to establish its nature, characteristics and functioning, in the same way that you could examine it in a shop.
We may make a lawful deduction from the refund if the product’s value has been reduced by handling beyond what was reasonably necessary.
Certain products may be excluded from the change-of-mind cancellation right where permitted by law. These may include:

products made to your specifications

clearly personalised products
-
sealed products that are not suitable for return for health-protection or hygiene reasons, where the seal has been broken after delivery
An exclusion will apply only where the applicable legal requirements are satisfied and the exclusion was made clear before purchase.
These exclusions do not affect your rights if a product is faulty, damaged, misdescribed or otherwise does not conform to the contract.

8. Returning a product
Before sending a product back, please contact us at support@kanjade.com and include:

your name

your order number

the product you wish to return

the reason for the return
If the return is accepted, or you are exercising a statutory right to return the product, we will provide the applicable return instructions and return address.
Our registered office at 71–75 Shelton Street is not a returns facility. Products sent to our registered office may not be accepted and may delay the processing of your return.
You must send the product back without undue delay and, where the UK statutory cancellation right applies, no later than 14 days after informing us of your decision to cancel. A voluntary return from Australia or New Zealand must be sent within the period and in accordance with the process stated in our Refund Policy.
We recommend retaining proof of postage until your return has been completed.
Nothing in this section requires you to obtain our permission before exercising a statutory right. Contacting us first allows us to provide the correct return address and instructions.
9. Refunds following cancellation or a voluntary return
Where a UK consumer validly cancels under the statutory change-of-mind right, we will refund the price paid for the cancelled products and the cost of our least expensive standard delivery method, where applicable.
For an eligible voluntary change-of-mind return from Australia or New Zealand, the amount refunded, including the treatment of original and return delivery costs, will be determined in accordance with our Refund Policy. Nothing in that voluntary policy limits a remedy required by applicable consumer law.
If you selected a more expensive delivery method, we are not required to refund the additional delivery cost.
For a UK statutory cancellation, we will issue the refund without undue delay and no later than 14 days after we receive the returned products, you provide evidence that you have sent the products back (if earlier), or you notify us of cancellation if no products were supplied. Voluntary returns will be refunded within the period stated in our Refund Policy.
We may withhold the refund until we receive the returned products or you provide evidence that they have been sent back, whichever occurs first.
Refunds will normally be made using the same payment method used for the original transaction unless you expressly agree otherwise.
We will not charge a fee for issuing a refund.
10. Faulty, damaged or misdescribed products
Blue Lantern Ltd has a legal duty to supply products that conform to the contract.
For UK consumers, the Consumer Rights Act 2015 requires products to be:

Your remedies may include:

the short-term right to reject the product

depending on the circumstances and timing.
For UK consumers, the statutory short-term right to reject is generally available for 30 days after delivery. Different or additional remedies may remain available after that period.
If you are an Australian consumer, you may have non-excludable consumer guarantees under the Australian Consumer Law, including guarantees relating to acceptable quality, fitness for purpose and correspondence with description. The remedy available may depend on whether a failure is major or minor and on the circumstances.
If you are a New Zealand consumer, you may have non-excludable rights and remedies under the Consumer Guarantees Act 1993 and protections under the Fair Trading Act 1986, including guarantees relating to acceptable quality, fitness for purpose and correspondence with description.
The applicable local law determines your precise rights and remedies. Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy where doing so would be unlawful.
If you receive a product that is faulty, damaged, incorrect or materially different from its description, contact us at support@kanjade.com.
Please provide your order number and, where reasonably possible, photographs showing the issue. Requesting photographs does not remove or restrict your statutory rights.
Where a product does not conform to the contract, we will bear the reasonable cost of returning it.
Nothing in our Refund Policy or these Terms limits your statutory rights.
11. Voluntary returns and exchanges
Our practical returns process is set out in our Refund Policy.
Any voluntary exchange or goodwill returns policy offered by us is additional to your statutory rights.
The conditions of a voluntary returns policy do not restrict your legal rights concerning faulty, damaged or misdescribed products.
Sale and discounted products are subject to the same statutory consumer rights as full-price products.
Any statement that a product is “final sale” applies only to voluntary change-of-mind returns where legally permitted. It does not remove or restrict your statutory rights.
12. Intellectual property
The content made available through the Website, including our branding, text, graphics, photographs, images, videos, audio, website design and the selection and arrangement of that content, is owned by or licensed to Blue Lantern Ltd and is protected by applicable UK and international intellectual-property laws.
You may access and use the Website for your personal, non-commercial use.
Except where permitted by law or with our prior written consent, you must not:

Nothing in these Terms transfers any intellectual-property rights belonging to Blue Lantern Ltd, Kan Jade, Shopify or another third party.
The Kan Jade name, logo and associated branding are trade marks or other intellectual property owned by or licensed to Blue Lantern Ltd.
You must not use Kan Jade branding in a manner that suggests an association, endorsement or commercial relationship without our prior written permission.
Shopify’s name, logo and branding belong to Shopify or its licensors. Other names, logos and trade marks appearing on the Website belong to their respective owners.
13. Reviews and other content you submit
If you submit a product review, photograph, comment or other content to us, you retain any intellectual-property rights that you hold in that content.
You grant Blue Lantern Ltd a non-exclusive, worldwide, royalty-free licence to:

store and reproduce the content

display the content on the Website and our promotional channels

adapt it for formatting or accessibility

use it to operate and promote Kan Jade and its products
This licence continues for as long as reasonably necessary for those purposes.
You may contact us to request that your content be removed. We will consider and act on that request where reasonably possible and where legally required.
You confirm that:

the content reflects your genuine experience where it is presented as a review

you own the content or have permission to submit it

you have disclosed any payment, free product or other incentive connected with it

the content is not unlawful, defamatory, threatening or misleading

our permitted use of the content will not infringe another person’s rights
We may moderate or remove content where we reasonably believe that it is:

We will not selectively suppress genuine negative reviews merely because they are unfavourable.
14. Third-party services and links
The Website is hosted by Shopify and may use services supplied by payment providers, delivery companies, review platforms and other third parties.
Your purchase contract is with Blue Lantern Ltd, trading as Kan Jade. It is not with Shopify.
Shopify provides technology used to operate the Website but is not the seller of our products.
The Website may contain links to third-party websites. We are not responsible for third-party content or services that we do not control.
A link does not necessarily mean that we endorse the relevant third party.
Nothing in this section excludes responsibility that we cannot lawfully exclude, including responsibility for third-party providers acting on our behalf where the law makes us responsible.
15. Privacy and cookies
Blue Lantern Ltd is the controller of personal information processed in connection with operating Kan Jade, except where another organisation acts as a separate controller.
We process personal information in accordance with our Privacy Policy.
Because the Website is hosted by Shopify, Shopify and other service providers may process personal information on our behalf or for their own stated purposes.

18. Our responsibility to you
We are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
Loss or damage is foreseeable if:

We are not responsible for loss or damage that was not foreseeable when the contract was formed.
We supply products for private and domestic use.
If you use a product for a commercial, business or resale purpose, we will not be responsible for business losses such as loss of profit, revenue, contracts, anticipated savings, data or business opportunity, except where the law provides otherwise.
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

If there is a substantial delay, you may contact us to cancel the affected order and receive a refund for products paid for but not received, subject to your statutory rights.

The Terms that apply to a purchase are normally those in force when the contract for that purchase is formed.
We will not retrospectively change the material terms of an accepted order without your agreement unless the change is required by law.

21. Transfer of rights and obligations
You may transfer your rights under these Terms where the law permits.

22. Severability and waiver

If a court or relevant authority decides that a provision is unlawful or unenforceable, the remaining provisions will continue in effect.
If we delay enforcing a right, that does not mean that we have waived it.
A waiver on one occasion does not constitute a waiver on another occasion.
23. Third-party rights
Except where these Terms expressly state otherwise, a person who is not a party to the contract between you and Blue Lantern Ltd has no right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999.
24. Governing law and courts
These Terms and any contract between you and Blue Lantern Ltd are governed by the law of England and Wales, subject to any mandatory consumer-protection laws that apply in the country or territory where you normally live.
If you live in England or Wales, the courts of England and Wales will have non-exclusive jurisdiction.
If you live in Scotland, you may bring proceedings in either the Scottish courts or the courts of England and Wales.
If you live in Northern Ireland, you may bring proceedings in either the Northern Irish courts or the courts of England and Wales.
Nothing in this section deprives you of any mandatory consumer protection provided by the law of the country in which you normally live.
If you live in Australia or New Zealand, this section does not prevent you from bringing a claim in a court or tribunal available to you under mandatory local consumer law.
